Indiana man guilty of dealing drugs

After a long day spent waiting for the judge and attorneys and then four hours of deliberation, a Grant Superior Court 2 jury convicted a man of dealing cocaine Wednesday night. Andre Waits, 30, whose last known address was 1204 E. Walnut St., was found guilty of a Class A felony count of dealing in cocaine, which carries a standard 30-year prison term.

Although closing statements were expected to begin first thing Wednesday morning, the jury spent hours waiting at the courthouse while Judge Randall Johnson and the attorneys conferred on legal matters.

Then, at about 2:30 p.m., closing arguments finally were under way, and the four-man, eight-woman jury began deliberations at about 4 p.m.

At 7:30 p.m., jurors returned with a verdict, but there was a problem: They convicted Waits on both the dealing charge and the lesser-included offense, a Class C felony count of possession of cocaine. By Indiana law, a jury can acquit on both charges, but may convict on only one.

"I think the verdict is an illegal verdict," Waits' lawyer, Marion attorney Craig Persinger, said.

Johnson then sent the jury back into deliberations with revised instructions, and at 8 p.m., jurors brought back their final verdict.

Waits' sentencing hearing has been set for Jan. 12.

The Class A felony charge stems from a Jan. 22 traffic stop at Ninth Street and Western Avenue. After Indiana police discovered Waits had no driver's license, he was arrested and taken to the Grant County, Indiana Jail.

While at the jail, Indiana police found a large amount of cash in his pocket along with a clear plastic bag containing 7 grams of crack cocaine.

After the verdict was read Wednesday evening, Waits became emotional while waiting for the jury to leave the courthouse.

"I knew they was going to come back that way," he said.
